| Help! Mortgage Note Issues Help Debtors Avoid Foreclosure This house that I own is in Florida. ISSUE # 1 - I took out a hard money loan with a trustee for a bank. He hs filed for a lost note. I believe that he cannot produce the original note. He claimed that He sent me his note and he had mine. Then I read a article by BOB IVRY of the Bloomberg News. Basically it describes how when mortgages are bundled and sold to other financial institutions, the notes are suppose to be signed over but because the rush of the subprime market these notes have been lost. So the lender can't foreclose because they have lost the note... Can anyone help me navigate this issue because it is my belief that this is what has happen to me. He has filed for a new note, and that has went through but I want to appeal it. I want him to prove he has the note. Can I appeal this anyone? Does anyone know of a lawyer that can handle this???? |
