HOme RentalWhat is the name of your state (only U.S. law)? California, I am attempting to rent a house, but am very suspicious of large home for low rent. Is there a website that I can use to insure a property being rented is not in danger of foreclosure? |

| IF a foreclosure has actually been filed, there would be a filing against the owner of record in the county courthouse. If he is in default, but not yet in foreclosure, there would be no record. If suspicious, maybe see if he'll agree to have a third party hold the security deposit in escrow to go back to you if the owner is foreclosed..

Home RentalsI have inquired about two houses for rent. The first asked that a credit check be submitted online before they would show me the house. The second was for a 4 bedroom home for only $1000. When they replied by email they stated to being a couple who relocated to Africa and they had the house keys with them as they were not going to rent the house at first and than changed there minds. Sounds suspecious. They asked for credit info as well. |

| **A: my father in South Africa is sending a cashier's check for a higher amount for the deposit and rent. Cash it and send me a cashier's check for the difference. |

The problem is that the person looking can't see the court record to find out whether or not there is a lawsuit against the owner. Also, if the bank chooses (for whatever reason) not to sue the owner and the house just goes to auction, there is no lawsuit to go find.

So, how does a title company search the title to make certain no Lis Pendens or other action that affects the RE has been started, if the court records can't be accessed?

| In WI, title searchers have to check BOTH the RODs and the court records.

| Good. The OP is in CA, not WI.
