Question

I am a tenant and found out the house I live in is in foreclosure


What is the name of your state (only U.S. law)? Texas

I don't know what to do I found out today that the house I just moved in in Feb is being foreclosed June 2. I called the tenant and all she said was that she is handeling it and changed the subject. I have 3 Kiddos here is my question. Should I wait and see what happens or should I pack up and look for something else? I been paying rent on time (1200) since we have moved in. I just don't want bad record on my part since it is not my fault.
Please let me know what I can do and what my rights are.

I don't know what bank the Landlord uses. The Landlord is not in real eastate.

the only thing that would make something bad on your record is if you break the lease without justification.

Did you mean you called the landlord?

You are in a tough situation but it does not allow you to break the lease. I do not know if the bank will speak with you but being a tenant in the property, you are an interested party to the situation and they may. If you can find out who the bank is, I would attempt to call them and ask them if they can keep you informed and what they intend on doing with you (the tenant) once they do foreclose.

I was currently in the SAME exact situation, but i only have 1 kid. but landlord lied and changed subject.. "everything is ok, i don't know whats going on." Was always their reponse. I don't know Texas law, but i do know here in Florida, you can search cases on the county website. Also, how did you find out the place was in foreclosure? I found out because we recieved documents from the courts. I read through everything and found the law group handling it. I researched them, called them, and have been in constant contact with them. I was told by the lawyers that if in fact the house is going into foreclosure, we could be in the court room while the final phase. we would then be able to make a plea that we love the house and would like to at least finsh out our lease. Florida has a new law that cannot throw tenants out because of landlord not paying and going into foreclosure.
So i would suggest start by looking in county records online, you must have landlords first and last name. then look through the paperwork you recieved and possibly has a law firm on there. One more thing we have here. In our newspaper, we have a foreclosure section. I saw a couple of houses on block and called the group to find out if our house was one of them. I hope this works out for you!
