Impending Sherriff's Sale


What is the name of your state (only U.S. law)? Pennsylvania (Monroe County)

A sherriffs's sale has been scheduled for Oct 30, 2008 at 10:30am. I am trying to sell the property (it's been on the market for over 8 months). My questions are:

(1) I have been told that I can request postponement of the sherriff's sale... I've tried calling the lender and all I get is an automated system and no human interaction. Do I go directly to the courthouse and petitiion the judge myself?

(2) If I filed a Chapter 7 bankruptcy, would that stall the process... also, would the house absolutely have to be lost in the bankruptcy?

There should be a lawyer for the bank (perhaps with contact info) in your foreclosure documents. Yes you can also petition the court.

No. Usually, the house passes through the bankruptcy intact (of course with still the mortgage on it).

Sherriff's Sale


Thank you for your reply, I appreciate the advice. If I can't reach the lender's attorney, then I will go to the court directly. Thanks.
