"inconsistencies" in file


What is the name of your state? Georgia
My husband and I closed on a new house in May. In August we were contacted by our local police station (financial crimes unit) because during a random verification process, some "inconsistencies" were discoverd in our loan application. The short version is that our loan officer forged some documents in our file (there is a signed police statement to this effect) and now the lender wants to be rid of the loan. Our loan has been sold twice since May, but now has been forced back to the original lender.
The lender is telling us (over the phone) that we have 15 days to refinance our house or they will start foreclosure proceedings. We have gotten nothing in writing. We want to refinance our house to be out of this situation, but don't know what our legal rights are. Who should pay for the refinance?

**A: start the refi immediately. Next, hire an attorney. The find out what docs were forged and file a complaint against the mortgage broker.
Do you know specifically what docs were forged and who turned the loan officer in?

Yes, and yes. The loan officer forged a name on the verfication of lease document. The person whose name and signature she used turned her in. Who do we file a complaint with? The police have dropped the case because the other party decided to file a civil suit.

Will not your original lender refinance for you? Have you talked this out with them or just ignored it hoping it would go away?

Of course you will initially be responsible for the refi charges until and unless you have a case to file suit (GO SEE AN ATTY) and go after the wrong doer. However at this point I am betting he/she is covering their assets, literally, and even if you get a judgment you might have one hard time collecting it.

We have talked to our original lender. They have verbally agreed to pay for the refinance, but we don't have anything in writing and they are less than trustworthy.

File your complaint with Georgia's Department of Banking & Finance.

Get an attorney to represent you in this very serious matter right away. There are Federal and state laws that have been breached..
