Katrina vs the mortgage co


What is the name of your state? Mississippi


We took the eye of Kartine while still at a CAT 4. Structural damage to the house (moved off its pier foundation, main beams for roof split, porch lost, fire damage from the candle (my fault), craks all over the cielings now from the foundation issue, etc).

I have a 5K deductable on my insurance (my own stupidity)

On August 30, as soon as my cell was working I contacted my mortgage co (lets call them Amerihell). I was informed due to the storm I would be given a 30 day deferrment. Due to my pay schedual I pay my payments on the last day of each month (Meaning Aug 1 payment is paid on August 31).
During the conversation I spoke with the woman about the way I pay and ask her if she could cancell the auto draft set for the 30th. She stated on her end it was to late but I could do a stop payment through my bank.

I did.

On September 3rd Amerihell sent me a nasty Notice of intent to forclose letter because of the stop payment. They also sent me a nice letter about the deferment (with a debt collector miranda at the bottom). I contacted them and was informed that because I took the deferrment (called something else begining with an M) I will have to repay the missing payment over the next 2 months (meaning my payments will now be 1200.00. 800.00 plus 1/2).
Had I known this was going to happen I would have never taken the deferment or stopped the auto draft.

My husband is self employed and I work a crappy paying part time job. The storm has shut my company down... no company, no money. This being our busy season I have already lost most of what we will make to live off of next year. With this in mind as well as both of us also being full time students (currently displaced but thats being worked on) its not hard to see that I cannot afford to make these beefed up payments. I however do not want to go into forclosure.

Any advise would be appriciated!

Again, you DID get her name and extension, right?? (see below)

Simple. Contact the mortgage company and refer them to the conversation you had with THEIR agent, giving her name and extension number and the date of the conversation.
I also have to say... that if you have been making EVERY payment 30 days or so LATE, maybe they just got tired of your breaches and your 'stop pay' was the last straw.

I really don't see any LEGAL issues in your post. You appear to be a slow- or no-pay... who has come up on a HUGE problem that all of your neighbors are also likely facing. There really isn't any 'advice' that anyone can give you to resolve your problem. It is entirely up to you and your mortgage lender to resolve this issue. You might need to consider bankruptcy..... and see if your mortgage company will allow you to affirm your property.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Hate to break it to you but MY credit report shows NO late payments (read: payments made on the last day of every month, not 30 days late).

Anyway.... yes I did get the lady's name and extention number.... that would be kinda stupid of me not to now wouldn't it?

I hate to break it to YOU... but I really don't care what your credit report says. Some lenders (and yours might be one) are just happy to get the payment and might not report it. That doesn't mean it isn't late. Or, they might just show x times 30+.

How are we to know your intelligence level?? You will be surprised how many people come on here claiming some kind of 'verbal agreement was made with someone'.... and don't get the information.
So, since you did, what was the EXACT response by the lender when you referred them to a SPECIFIC conversation (date, name, etc.)??

I think the point that OP was making was that they paid their payment by automatic bank draft and for what ever reason the agreed transfer date is the 30th of the month, that is why they are not reported as late on their credit report. However, they cancelled the AUG payment due BEFORE the hurricane hit not the one after SEPT which could be deferred, that is what triggered the notice.

So, since you did, what was the EXACT response by the lender when you referred them to a SPECIFIC conversation (date, name, etc.)??

I did not come in here ranting about a trailer sitting in some crappy back woods park and whining about my husband/ cousin screwing my sister/ aunt.
That alone should give me some intelligence points.

I'm kollege ed-u-kated (and going into law school next fall, scary isn't it?) Of course you have no way of knowing that but lets give a person the benifit of the doubt before jumping to conclusions.

None the less- no one else will speak with me. I have been assigned a *disaster specialist* whom I am to deal with (the one who told me to stop payment). She, I am told is the almighty one who is handeling all with my loan.
