Landlord in ForeclosureWhat is the name of your state? NV We recently found out our landlord is letting this house go, it went into default on March 7, 2008. This house is in Clark County, Nevada. On March 27 it was listed at the County recorders office as substitution-Trustee, my question is, How long do I have to pack up and move, I know I need to do it right away, but I don't want to come home one day in the next week to find the doors locked. What is the name of your state? What is the name of your state? What is the name of your state? |

| You have to be served, and evicted. Have you called the foreclosing lender's attorney? The banks I work with is happy to work with the tenants in upcoming FC's who are cooperative. For example, if they will clean up well after themselves and leave voluntarilly, rather than force them to evict, they will negotiate a cash for keys deal.

| Have you been served with anything? Why not just call the attorney handling the bank's FC? I talk to tenants in default properties all the time, and am happy to review the status and time frame for them. We are even open to working with them on selling to them if they may wish to stay.

| The court case file should state which party represents the lender and who filed the LP. Look in the court records, not just the RODs records.

| I can't find anything on NV post foreclosure but it would seem you have seven to thirty days from the time the buyer serves you notice. As others have pointed out, you should contact the lender, as there's a strong possibility they will also be the owner after the foreclosure. If not, you should contact the new owner to see what their plans are for the property. You may be able to negotiate continued rental or at least an orderly departure. |
