Legal status of broker contract and communication?


What is the name of your state (only U.S. law)? IL

Long story short, I acted in haste in signing something that I have no idea what I actually signed. This was in part due to some personal circumstances with my relationship (which I know is no excuse).

It was briefly explained to me that it basically states that I will use his services if lenders are found and I buy within a certain time period.

Now, I feel like I’ve been getting the run around as he is not calling me as much as our initial days of meeting. He verbally stated he would have an answer back wether or not I should go forward with the actual FHA application. I left a VM yesterday morning at 9am and then I e-mailed the company around 4:15pm. I tried calling again around 6:40pm with no answer. My e-mail requested copies of the documents I signed and explained how uneasy I have become due to the lack of communication. Around 4:40pm yesterday or so as I was checking my e-mail from home, I had gotten a response.

Briefly saying the lender apologizes as he is backed up, claims he got no VM and can mail or fax the documents. I immediately requested they be faxed this morning to my work number which was already included in my signature on all my e-mails.

I am to the point where if I don't get copies of these documents this morning, I am going to write another e-mail. I want to state that it appears you were unable to find a lender and thank him for the oppurtunity and consider this an end to our business relationship. Obviously I would expect to get the documents shortly thereafter much like how they e-mailed be so promptly but I had already left from work.

I have since been in contact with an actual lender and have already been through and submitted my FHA application with National City Mortgage and paid a $55 fee for the application. This lender provided me conflicting information versus what this broker had told me.

How should I go about ending this business relationship due to the lack of communication and supplying me with the documents I signed? It's already 9am on the day I requested the documents. I have saved all my e-mails and I just want to have a clear head as I was freaking out last night to the point of sending a fraud alert.What is the name of your state (only U.S. law)?

The answer to your question is contained in the "something" that you signed. If you do not understand the contract, you really need to see an attorney.

I understand that. My point is I don't have a copy as I have requested twice now within the week.

Is this grounds for writing a letter stating that I consider this that you were unable to find a lender and will terminate our business relationship.

Well I spoke with him this morning as he actually answered the phone today around 9:30 am. Said he had not seen my e-mail response yet this morning with the fax number I provided. Said he would be in the office around 20-30 minutes and would fax them.

Still waiting on this and it's really bothering me

That is exactly what I did today after waiting for over 5 hours for the documents. I finally got copies of them and I REALLY overreacted.

One of the forms was simply a credit disclaimer and a borrower authorization that all the wording pertains to me submitting an application. I am off the hook of anything and I feel SO much better.

I am pursuing a lender directly still but I have now realized how much time this is going to take. The application stated 5.5% and everything looked good.

But due to the time, I have to find a short-term lease within a week

I love this forum despite a few haters / power trippers but I do love to defer to you guys.
