Lender not reporting credit

So, I just made a call for my Brother In Law, to his Mortgage Company to find out why after 11 months, the Home loan is still not showing up on any of his credit reports.

I was informed that the loan had been sold to a private investor, then bought back by the original Mortgage Co. and now resold to another investor.
I explained that they are planning to refi. very soon, but can't because the Mortgage is not showing up on his credit report.
She told me that the best that she could do was Fax/Mail a letter stating that all payments had been made on time to us.

Is this legal for them not to report the account on something as big as a home loan?
If we were to have defaulted on this, I guarantee that it would show up on his credit.
At this point, is there anything we can do?
