liens on property


What is the name of your state (only U.S. law)? Pennsylvania

I own a rental property. It is presently vacant. It has a first mortgage and a second mortgage lien. I filed for bankruptcy and included these in the petition. My discharge was received in June 2008. The property is about to go to sheriff's sale in August 2008. If I want to stop this sheriff's sale and the foreclosure process from continuing and want to keep the property and work out a new mortgage with the first lien position, will the second lien need to be considered since my discharge included both of them...

A lien going into bankruptcy is a lien coming out of bankruptcy.

You will probably have to deal with both lienors.

The secured lien is not eliminated, it is still secured by the real estate. You can't do anything with the real estate without dealing with the mortgage.

lien question?


first mortgage has released you and second put a lien on you? how much is the lien?
