Loss Mitigation


What is the name of your state? New Jersey
My situation is quite confusing. We filed Chapter 13 back in 1997, we completed our plan. After a years time our mortgage company said we owed them like $20,000, for what I have no idea. So we didn't have that kind of money. We were paying our mortgage month after month, but our escrow was getting further and further behind, they were going to foreclose on us, so we decided to file Chapter 13 again to save our house. In the mean time we tried refinancing but our mortgage company would not cooperate therefore no one could help us out. So our mortgage company sent us a letter and said to call and they will help us out. So we called and talked to Loss Mitigation dept. We were to pay a certain amout every month on time and after a year they would do something to help us out of our mess with them. So we have done that actually it has been over a year and we haven't heard nothing from them about it but for the whole time we are not paying enough to cover our mortgage payment and taxes so therefore our escrow is still in the minus. Another mortgage company said they were going to refinance us at 8.50 percent but when they got the history of our payments one paper said we have been on time for the past 24 months but another paper says we owe $18,000 and we are 12 months behind. How can this be? This new mortgage company says there is nothing they could do unless we clear up the $18,000. They seem to think something shady is going on here, we don't know what to do, we were told we should get a lawyer, but I have no proof of anything. Can someone please help us out??

You haven't paid your mortgage and you are getting foreclosed on, right?
