I unfortunately found one of the bad apple attorneys. I paid $1500. him to have my HAMP loan modification/loss mitigation go through the Southern NY Federal Court along with my Chapter 7. A couple weeks went by - when I reached out to him he said the Court does not allow loss mitigation on chapter 7's, only 13's. (I called the Court Clerk and found out he never applied through the Court at all and the Clerk confirmed they do accept all chapters of bankruptcy). My attorney then proceeded to file for a loan modification privately. Long story short -- he messed this up and I resubmitted the modification myself. Now I am on track. However, the mess he created in misleading and incorrect documents is causing delays with my bank and after speaking to my loan specialists, he agreed and said I need to do what is in my best interest. That is submitting the loss mitigation through the Court myself and get the Courts (Judge's) eyes on the process. *The bank has been very helpful, they call me weekly.

I have read numerous articles starting with the NY Bankruptcy Court web site under the correct Chief Judge's loss mitigation process. This process seems simple enough, however, the language and exact steps are not in a layman's format. This is where I need assistance. I am looking for a "loss mitigation for dummy's" type of guidance. Finding another attorney has two issues. One, I have not found an attorney that will get involved with the first attorney's mess; and I really can not afford another attorney if I found one.
