I am presently trying to refinance my home and have been told by the brokerage company that my new wife(who isn't on the mortgage) needs to sign the papers also eventhough she isn't on the loan. I would prefer to keep her off of the loan all together to protect myself from any future problems if I should divorce. The loan was approved in my name only and I am told that the mortgage would only be in my name, but that she needs to sign the loan also because of state law. I realize that my present wife is entitled to whatever equity may build in the house from the day that we married but I would like to protect my investment in the house prior to my marriage to her. If her name is on title to the property then the lender will most likely require that she also sign off on the mortgage. Otherwise there would be a problem if they went to foreclose on the mortgage lien, which was in one person's name, while the property is in both names.
