Messy Situation


What is the name of your state (only U.S. law)? NEW MEXICO

3rd time trying to post here! Posted on another forum and received a 'canned' response. Hope there is more help here.

Divorced. Court awarded house to ex. I was ordered to pay her $25,500 so she could pay off the 2nd mortgage(she did not) and sign a quit claim deed to her. She was ordered to sell or refi. within 30 days to remove my name from both mortgages (she did not). These orders were from the GAL and adopted by the court. In 8-07, I did as ordered. In 9-08 we were in court because she still had not done as ordered. The court gave her a slap on the wrist and more time due to poor market conditions. A special master was assigned to help facilitate/oversee the sale. Her and her husband live out of town and the house sits vacant. She does not work, but her husband has been paying for everything; mortgages, lawyers and child support, etc for years.
Over the summer, I began receiving notices from my credit card companies that my limits were being decreased and I was denied credit from a motorcycle dealer. I inquired to Experian as to why...they have not made a payment on either mortgage since 6-09 and guess whose name is STILL on the mortgages? Now, I have received a foreclosure notice. The GAL and her attorney have received notice as well because the have put liens on the house for fees due from her.
What can I do? Is the court to blame for not enforcing IT'S order? Is the GAL to blame for not enforcing HIS order? There must be some course of action I can take against her, civil or otherwise, right? Can I take action against the GAL and/or Court? How do I deal with the mortgage co. and their attorney that served me?

You can pursue the issue in court. Depending where this is, it could be a 'motion to show cause', 'motion to compel' and/or 'motion for contempt'.

No to both. The court only decides the issues.. it is up to you to pursue the available legal processes.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

I have done the 'show cause' and contempt route, court just gave her more time.

Anyone else have some input?
