Modification Mess


What is the name of your state (only U.S. law)? CA
By brother is in a mess. He originally tried to do business with a mod company (I know bad, but he didn't) with plenty of time to get a mod done. Long story short, mod com dragged feet, didn't answer phones, etc. 1-Week before sale date I found out that there was no authorization for mortg company them to speak to mod company. Somewhere between 4 pm and 7 pm 3 days prior to sale date, the mod company did get a modification but apparently at the same time we (my brother and I) were telling the mrtg company not to deal with them and mrtg company gave us the details of the mod. The Mrt sent the paperwork to the mod company who never sent it to brother. Brother western unioned the money to the mrtg co on time but not the paperwork (on a friday). Again, long story short. the following monday they sold the house. Do you think there is any recourse to get them to undo it. The mrt co upper mgmt has talked to their legal depart, reviewed telephone calls, etc. I specificaly remembered asking for paperwork and their Loss Mit Dept would not fax it to us, they faxed it to the mod company only. and left it there so far,and we haven't heard anything. They did admit hearing us tell the CS rep not to allow the modification company to speak on his behalf... Trying to get a lawyer to call him back is a nightmare but we are trying.
