Mortgage company never sent payoff statement,now want to charge interest

I had spoken with our mortgage company early last year, and was told it would be a partial payment in Feb. 2006 to payoff the mortgage. They said a payoff statement would be sent around a month before. Our mortgate company never sent a payoff statement, and did not take our automatic payment on Jan 9,2006 as we expected. I contacted them the next day to inquire, and they said the automatic payment was greater than the loan amount, and so they could not take it. They asked why I didn't rrespond to the payoff request, and I stated I had not recieved one. They checked their records, and found they had not issued one. They are now charging me interest up to the payoff. I think this is wrong as it was their error. I don't think I should have to pay the January interest. A supervisor's supervisor agreed, and then lied to me, and charged me it. She now will not return my calls. Am I off base here?

Unfortunately, their stupidity (which is rampant in mortgage lenders) do not relieve you of paying your bills.

But if they had taken my automatic payment, there wouldn't have been any January interest, as the loan would have been payed off.

And if you had made your payoff request and intentions in WRITING, there likely wouldn't be this problem.

Your ONLY recourse is to try to negotiate the matter the best you can.... and if not successful, pay it. The amount can't really be enough to worry about.

The mortgage company had said the payoff would be in February, why would I have requested a payoff statement in December?

How the hell do we know what you requested, when you requested it, and for what reason??
You're the one who is whining over what is likely less than $50.
Accept it or file a lawsuit. Those are your ONLY LEGAL options.
