Mortgage Fraud?


What is the name of your state (only U.S. law)? Georgia

In Feb 2007 I took out a 2nd Deed of Trust on my home that I own jointly with my fiance. National City Bank approved me and sent a notary public to my house.

1. My 3 day cancellation paper incorrectly stated I was creating a mortgage on my home when in fact it was a deed of trust, 2 very different liens

2. My 3 day right to cancel was miscalculated by at least 2 days

3 My interest rate is miscalculated as well. It is off by about .25 basis points, lower than what it should be.

4. The Deed of Trust was altered after I signed it and BEFORE it was recorded at the courthouse. My fiance's name was added afterwards to the first page as grantee.

5. A new signature was added to the witness section. This person was not a witness to the transaction.

So my question is the following:

Is this a valid Deed of Trust in Georgia? Can my Fiance file a court action and have the deed removed seeing that she never signed the document, only here name is on the first page and I signed the Deed of Trust.

Did National City violate Regulation Z ( truth in lending act) and therefore allow my 3 years to rescind the mortgage?
