is this mortgage harassment?


What is the name of your state?TN I am 35 days late on mortgage payment as of yesterday nov.4. It is in the mail. My mortgage company called 2 different people that live in the same town that I do, looking for me to contact them about my late payment. These people are no relation to me and I certainly did not give them out as contact information. So I can only assume that they were calling numbers out of the phonebook. Isn't this some sort of invasion of privacy? At the very least it is embarassing for people that I'm not close to, to know my personal business. I called my mortgage company to confront them about what happened and all supervisors were gone for the day so I left a message and someone should call me back on Monday. I would like to have some knowledge about the law before I speak to them and appreciate any help,thanks.

If these were random people they called out of the phone book, then they were beyond lucky to find two people who just happened to be very good friends of yours.

I'm also not 100% sure, but I think when someone is trying to collect what is rightfully owed to them...it's not necessarily harrassment?

I you would have just paid your mortgage, guess what......you wouldn't be having this problem.

I hope you sent enough for 2 payments and any late penalty, because 35 days late with your last payment also sets you 5 days late for this month's payment (which will not be received until next week). What do your loan papers say will happen if you are 2 payments behind? It certainly gets their attention. Why don't they have your phone number?

Many mortgages give you a 15 day grace period. But later than scheduled due date can decrease principal paid, resulting in extra interest factored into final payment, or settlement cost for future refinance.

What in god's green earth is "mortgage harassment"? Is it anything like "house harassment"?

Naw. They did a skip trace on you. Mostly likely, these were either people who lived on the same street as you (your neighbors), or they were people that, at some point (and it could have been years ago), you listed as a contact for something. I had a company call me last year trying to locate an old boyfriend that I hadn't seen or heard from in over 15 years--but 15 years ago he listed me as a contact on something.

Is this a pattern for you to be late? If they were this persistent (why the heck don't they have YOUR numbers) then you might start taking this serious BEFORE they start insisting you pay the past due AND the current payments or they will accept neither one from you.

When you call all hot under the collar you might remember you were late on the payment and they simply wanted you to live up to your contract with them. If you had or called and discussed your situation with them directly probably would not have happened.

Credit harrassment rules are completely different for the original creditor who is trying to collect.

Suggestion, cool off and call them and give complete information on contacting YOU.

Over the past weekend I have received calls from 4 other people in my town that I dont even know. The mortgage company does have contact information on me along with 2 numbers of my own. I do not understand how they have a right to just call anyone that I have NEVER put down as a reference. I had spoken to them previously and told them why I was late and when they would receive payment.I would understand if I was several months past due and they had no way to contact me but that is not the case.
