| | | Mortgage in my name, on my credit report, and I didn't buy a home. What is the name of your state? North Carolina
I am in the process of trying to obtain a mortgage to complete my purchase agreement I have already signed to purchase the condo/town home that I currently reside in. During this process, I have discovered that there is already a mortgage in existence in my name, in a city and state I have never lived in. In fact, I was living 2000 miles away during the time the mortgage was secured. This is seriously hindering my ability to complete my purchase now, as apparently whoever secured this mortgage in my name and with my SSN defaulted on it. I strongly suspect my ex-husband and his new wife but I can't prove it.
This is the biggest mess because I really need to get a home loan because my LL is being a jerk. Any advice on how to get this off of my credit report and prove that I did NOT buy this other house???  |

| | | Have you contacted the (fraudulent) mortgage company? Filed a police report for identity theft? Contacted the big 3 credit bureaus?

| | | Does your ex live near the location where the home was purchased? Have you secured documents from the Mortgage Co concerning this loan you allegedly took out? Have you contacted the FBI? How long ago? Can you find the loan officer and determine if he/she ever met with the purchaser in person or was it all over the internet? Can you determine what identification was used to secure the loan, SS card is not a legitimate ID?
It could be that your SSN was used to obtain a loan by an Illegal Alien who simply picked a number out of the air.
Somewhere a lender dropped the ball in requiring proper identification to process the loan but is a lot easier to do with a no doc loan.
Who is the lender?
Is this the only think on the credit report besides YOUR credit history, no other credit cards, loans etc.?
Do you have an Atty working on this because it will not be an easily cleaned up mess but it seems to em there is a way around it with the new lender if you can prove you did not make the loan. One of our lender type people will come around and perhaps give much better advice to you. |

| | | Obtain copies of the mortgage in question (available through the public record). Contact the title company, if any can be determined by looking at the docs. Contact the lender and notify them you did not execute that fraudulant mortgage and that you insist on seeing a copy of the id presented at the closing and that you challenge the validity of the loan. You may need an attorney. You may want to contact your state attorney general or Dept. of Financial Institutions in case THERE ARE OTHER INSTANCES OF THIS MORTGAGE company being involved with fraudulant loans. They may have failed in their due diligence, or their closing agent did.

| | | Not my mortgage Yes, he does live nearby the city and state where the home was purchased. It was about 6 years ago. Supposedly, the credit repair service I have been working with prior to finding this out was taking care of resolving this issue. I no longer use that service and I have no idea where they were in the process. Another incident that took place a few years before the mortgage was obtained is that my mother's purse was stolen while she was at the post office. My mother had an address book/organizer in that purse that contained the SSN, addresses, DOB, names, etc. of all the members of our family, including my daughter's. I have checked her credit report periodically and there has been no activity on hers and neither has there been any activity on the other family members, which leads me to believe it is my ex. That and the fact that something like this would be right up his alley.
There is a credit card account around that same time frame but by far, the mortgage is the biggest issue right now, as it is preventing me from utilizing first time buyer programs, not to mention the ability to even secure a home loan.
I do not have an attorney but judging from the advice I've received, I think it's time to get one.
Now I've heard of identify theft like everyone else has, but I never dreamed it would be possible to do something as difficult as get a home loan pretending to be someone else!
It's really awful because now that I'm ready to buy and in fact living in the home I'm attempting to buy and I really love this place, now I'm running into this. |

| | | Knowing what state and county the property is in will narrow down where you can get public records and if you can get them online...
you might try a google search with these words: county recorder "name of county" "name of state"
that might give you a website, then you can search public records online (keep in mind that not ALL recorders or registrars have online search capability. |

| | | Okay have you "alerted" the ex that you know what has happened, if in fact it is the ex (sounds pretty likely) or would a little "surprise" work at this point?
Can you show up at the door and see who is living there?
How was your credit around that period of time, if excellent they probably got it with little or no documentation.
You will need an Atty to get this settled, "ain't" that the pits, you do nothing wrong and it cost you to clean it up.
I have a friend in the broker biz and I will find out how she resolved just such an issue not to long ago so check back! |
