mortgage question


What is the name of your state?FL
First our mortgage company incoded a payment wrong we stopped payment on that check and did a payment by phone we thought that was it .wrong.They still five months later are still trying to resubmit the check we stopped payment on we have called since june of 05 and we talk to a supervisor that can do nothing to help they see the problem but cannot correct it so they say we are one month behind always.

If you made every payment that was due, then the account should be showing as current (yes, I know I'm stating the obvious ) despite the 'stop-payment on the check/check done over the phone' incident. Are you sure all the payments were applied to the account (one might have gotten misapplied to another loan) and that they were actually applied as payments (as opposed to all the money being applied to escrow or principal--which shouldn't have happened, but...) If you haven't already done so, I'd ask for a copy of the payment history.

We did that on aour next payment certified rrr mail we got the reciept back stamped not signed they said fax a copy of paper work we did that but they say they will have to research this matter and it can take 30 days once reseach gets the info.

What does this mean? They call and say hey we encoded your check wrong?

First our mortgage company incoded a payment wrong we stopped payment on that check

Your post makes little sense unless we start from this premise you wrote them a check to buy a little time and then you did not have the money in the bank so you stopped pay on that check. And when the funds would clear you called with a phone payment.

Now, who did you stop payment with, your bank? If so then you should be protected for 6 months only, in most cases. You need to do another stop payment until this is resolved. But again this makes no sense because they can only submit the check the first time, then one additional time.

Want to come clean?

First the money was in our bank! our mortgage
company encoded it for 1660. the check was only written for 732.19 so what do you want us to come clean with.We stopped payment on that check and immediatly replaced it with another!! they still can't find there mistake months later now they are looseing checkes that are sent ceterfied returened repicet. SO WHO NEEDS TO COME CLEAN!!

About to lose my home

I am about to lose my home and I don't know what to do. It seems as though people are communicating in this thread and I am very desperate. I purchased a home with my ex and we broke up. She said she is filing a Chapter 7 Bankruptcy. Can she do that without my permission?

Do you get paid to be a jerk? Are you an attorney? I most certainly would not hire you if you are an attorney. It shocks and saddens me that ordinary people like myself, who do not have a law degree, cannot count on or trust in good, quality, sensible advice from someone who is supposed to be educated well enough to be able to handle difficult legal situations. Who are you to judge? Do you place yourself above others so much that you forget that you're human just like the rest of us; or is it that you simply cannot show compassion for others? This makes me SICK TO MY STOMACH! WHO DO YOU THINK YOU ARE? God forbid you ever find yourself needing the advice of someone who is above YOU. GEEZ! I cannot believe the audacity.
