| Mortgage Statue of Limitations What is the name of your state? New Jersey
I sold a home in 1977 and took back a second mortgage, which is now the senior mortgage. I am holding a mortgage that was properly filed on March 1, 1977. It was never paid. It shows up on all title searches for this property. Now a company has a lien, junior to mine and initially wanted to pay off my mortgage.
They hired another attorney who writes:
"Pursuant to Security National Partners Partnership, ltd, v. Mahler, 336 N.J. Super 101 (App. Div. 2000), your mortgage dated March 1, 1977 is unenforceable because if falls beyond the twenty year Statute of Limitations period outlined by the Court."
Is this true? Can they just ignore my mortgage?
