Need Advice for CA - Forclosed and need to go to courtHello, I have a few questions regarding a few disputes that I would like to file in the state of CA. I forclosed on my property Jan 2007. My 2nd mortgage is still open, the house short sold from the bank for the amount of the 1st. My 2nd was a HELOC. 1) My 2nd mortgage wants to have me sign some paperwork to close the 2nd mortgage which I owe $150k for, they say if i pay at least $3,000.00, they will close it since the first is forclosed. When i received the paperwork to fill out for it they want me to send them 2 recent pay stubs. Why would they need this? I am afraid they will try to garnish my wages and not settle for the $3,000 if I do send them. Any advice? 2) I purchased my house with 3 other partners - we signed a written contract in November of 2005 - not notarized. I want to take these guys to court over the amount they never paid and caused me to forclose. What are they liable for? Only the payments that were paid or for all payments that were charged? What if the amount ends up being $15,000 each, how should i take them to court? Since I have a written contract, is that good enough to win the case or do I need statements from a couple roommates that would act on my behalf? 3) When we purchased the home, we signed a contract for receiving an amount of money to buy it. They changed the amount from say $20k to $15k for taxes that they had to pay, can I go after that amount since I have a written contract for the full amount? Only problem that I have is that they gave each of us 4 the money directly and I have no information from the other 3 guys. 4) Can the courts find people by just their name? I have no information about my fellow investors as we parted ways after we lost the house. 5) Can anyone suggest a good real estate lawyer that I can either speak to over the phone for an hour, or consult in person for an hour? I will pay... 6) Written contracts in the state of California are good for 4 years or 3? I spoke to the court and they told me 4 years.
