Question

not quite floreblosure confusion w/ chap7


What is the name of your state? WI


I looked at a house this past weekend. Met the current owner of the house because his realtor could not make it. Good thing cause I should have talked to my realtor anyway. The house is on the market currently. though when my realtor tried to set up a time to see the house we were told the house would be going into forclosure and I could not get in to see the house. I checked on the guy and he filed chapter 7. At this time the house is still listed. I contacted the listing agent by email and received a responce today saying they would be happy to show me the house. (I used a different name) My question is if he filed for chap 7 in say june & had another court date this monthhow do I figure out the status? I called the clerk and they have NOTHING on record about forclosure. Why would he not want to sell but have it on the market for sale? Is there anyway to push this along?

Foreclosureit and BK's can affect who the property even belongs to and is in limbo until the BK is completed. Could be the BK will even save the home for the owner and it will not even be for sell.

Keep asking questions.

chap 7 / pre-forclosure


I have talked to the current owner and he is not trying to save the house. At this point he says he is just staying there not having to pay mortgage due to chapter 7. He says to be patient and house will go up for auction. I want to get all my ducks in a row and have all the things done that I need to have done so I can purchase it at auction. He stated that I should get the house at a cheaper price than he has it even listed at. I have looked the address up in some systems and it does not show up at all and on other systems it says pre-forclosure. My guess he can not sell it even at the listed price due to the fact it will NOT get him out from under his dept.
