My families rental properties were being foreclosed on in 2009 after the crash made it impossible for them to pay the mortgage. When my brothers showed up to sign the property over to the bank there was a private individual there. They were told to sign the property over to him, which they did as they were in a very tight spot. Isn't this illegal?

The private individual was a trustee of the bank.

We have no money now but the properties were worth several million.
