Predatory Lending


What is the name of your state? Kansas

I posted in another thread the situation in regard to this brand new house (4 months old) having major structural defects/problems that have gone far beyond any reasonable amount of money to repair.

The builder I purchased the house is also the mortgage company. In my quest to get answers and relief for a house I am paying a nice mortgage on and is not what I signed a contract to get, I found out that I am a victim of predatory lending.

It has been substantiated the mortgage company manipulated my interest rate. (the company is not local - however I found in my research the mortgage company is licensed to sell mortgages in the state of KS) I also had to sign an arbitration clause, which I have found out is horrific, I had to use their mortgage company if I wanted their incentives, and I had to use their title company (this is against RESPA section 9) In addition, they used their own flood certification company and tax stamp company, CA and TX respectively, even though the house is located in KS.

I have been diligent and filing complaints with various government agencies, the banking commission etc.

I am spreading the word in the subdivision (which is brand new) to all those that hold a mortgage with this company that they are probably victims too. I tell them to have someone review their documents to ascertain if they have been harmed and then to file complaints.

What else can I do? I am working hard to get them to purchase this house back. Even if the problems were fixed, the stigma to serious foundation problems would degrade the asking price if and when I would sell it. Since the house is now moving off the foundation (remember this house is only 4 MONTHS old), I wonder how much hope there is for it anyway. It should have never been built, not passed any inspections (which BTW, the city is sweating bullets right now) nor sold to me as a quality home with no imperfections and/or defects.

Any help, assistance or name of people that may help, I would be most greatful.
