Probate Necessary

What is the name of your state? Oklahoma

Before my mom pasted away she filed a quick claim deed and gave me ownership of her property. She still owed a home mortage on the property and when I asked the mortage company to refinance the loan in my name, they said that I need to take the property to probate court.

Is this correct.

Depends. Did she, alone, have "good title" to the property? A quit claim does NOT warrant the condition of title. Did she have a spouse predecease her? Was their interest properly transferred to mom?
