purchase from spouse?

I live in Florida. My husband purchased our home in his name only and has had problems with the mortgage that has led to a current Chapt. 13. This is not the situation we hoped for but refinancing was not an option due to <500 FICO. We wanted to keep the house. Is it possible for me to qualify for a mortgage and buy the house from him at a higher price than what he owes to buy out of the Chapt. 13 and pocket some repair expenses? I live in the house too and Florida is a commonwealth state so I already have a vested intrest in the property by way of marriage.
