Quit claim fraud? >


What is the name of your state?

Florida.

Im buying a house from Peter (in foreclosure).
Peter bought this house 10 month ago like a favor for John (john was the previous owner , he default and utilize Peter credit and name to get money and start over, peter never receive a dollar from it)
Peter never lived in the house but is the legal owner of it( by title search that i did in public records, and only owner in mortgage too)
Now Jhon still lived in but didn't pay as agreed , now the house is in foreclos,and i told him im buying from peter and he's saying that he have a quit claim sign by peter right after the last closing and that i can't buy nothing, but he never record it, Peter says thats a lie , that he never sign nothing ,The fact is that Peter sign a Quit claim over to me and i record it yesterday(monday 08/01), now my questions are.>
1. how can i pull John out of my house if he fake a quit claim from peter?
2.since theres no lease contract and Peter credit is destroy can i force john to abandon the house?. and how?
3.is this an eviction scenario? how much i will pay for it? more or less.
4.can i be sue for taking john out of the house ? whats the risk on it?
John does not have a dollar for nothing.he just wants the house to get lose in auction.and live for free for the time is coming to the auction.

I will really appreciate any help .

I am in Florida to and have some experience and hope it helps, pleade know I am not an attorney and this is just advice you might want to look into

1. how can i pull John out of my house if he fake a quit claim from peter?

Peter should notify the county records (ASAP) and file a fraud caim against John

2.since theres no lease contract and Peter credit is destroy can i force john to abandon the house?. and how?
That means he is a Tenant at Will, ie: month to month, find out the evictio0n process for your county - I have done an neviction in both Pasco and Pinellas and it was easier inm Pinellas.

3.is this an eviction scenario? how much i will pay for it? more or less.

You will pay roughly about 200, plus any court fees if you go to court.
You will need to get the eviction packet from your county court house

4.can i be sue for taking john out of the house ? whats the risk on it?

First off John should be doing the eviction unless he signs a Power of Attorney over to you (50 bucks at a local attorney) then you can without issue.
