My ex & I filed in April 04 and received a discharge. House was included but during the divorce I got to keep the house so long as I made payments. It was too much for me and after receiving the advice of BK lawyer, I stopped (we had not signed a reaffirmation agreement). I moved out of the house 2/05 and informed the lawyer for mortgage company through letter from my lawyer. The house is still empty and they said it is still mine until foreclosure process is done (up to a year).
I want to give someone the keys or even have a real estate agent show it (many people have been interested in it) instead of letting it sit. What can I do? We have actually sent the mortgage lawyer a couple letters saying that I would sign it over if they would send the papers instead of dragging this out. |

| | | If the house has any equity, sell it. Don't just sign it over to the bank. You might be leaving money on the table and you may be detroying your credit for no reason. Find a reuputable real estate agent in the area and get a market opinion done. Do it today!! | |
