Real Estate mortgage question


What is the name of your state (only U.S. law)? Virginia .. My father died in November 08. He was the total caregiver for my mother(she has had 4 strokes) My mom had to go to a nursing home due to his death. She is medicaid eligible for her expenses. My question comes because my dad and mom have a 7 acre farm with a house and a mobile home on it. My dad also had a loan against his place for about 37 thousand dollars. The place is valued by the county at 59 thousand dollars. After his funeral expenses and other expenses there is not enough money left to make loan payments on this lien. The house and farm is in both of my parents name. The social services dept. says if the lender forecloses due to non payment it won't hurt my mom's medicaid eligibility. I just want her to be taken care of. Should I just not pay or send a correspondence to the lender . I am lost and have no where to go. My sister nor I have the money to make these payments either. Thanks

You and your sister are not under any obligation to make these payments. You'll lose the farm but it should not affect you or your mother. If the property was held jointly by your parents, ownership reverted to your mother on dad's death.
