Question

recording of balloon rider


What is the name of your state? Missouri

If we have a loan that has a deed of trust recorded but no balloon payment rider, but the lender says it has a rider and has one in their file that we signed is that good enough, I would of thought it would have had to have been recorded with the deed of trust in order for it to be effective.

The only legally valid document is the one with the signatures of the applicable persons.

The balloon rider is signed at least the one they have in their file is, they just never recorded it with the deed of trust so my guestion is does it make it any less legal since it was not recorded with the original deed of trust and just in their loan file?

Recording things is to protect the rights of the person making the recording. It does not affect their "legality".
