Relief from StayWhat is the name of your state (only U.S. law)? Georgia My husband and I filed Ch 7 bankruptcy in July 2008. At first we intended to surrender our home. Just a week after filing our mortgage lender offered to reduce the interest rate, extend the loan and lower the payments. We agreed and sent paperwork in. Since we have gotten behind again, and on Nov. 4th received paperwork from an attorney representing our mortgage co. stating they were asking for a relief from stay on Dec. 3rd. We realize there is no way to catch up and will be letting them foreclose. We are really just trying to get an idea of how long we have until we have to get out of the home. With 2 small children and Christmas approaching we are anxious to know what will go down in the coming weeks. |

| Georgia Foreclosure Laws Assuming that this site is correct (and I do not vouch for it), it looks like you'd have a minimum of 30 days from the time the foreclosure started. There are two kinds of foreclosures in Georgia, so you need to know what kind you are going through.

| I am hoping that is indeed the case as my husband and I have both called the lawyers office twice a day everyday since the letter came with no return call yet. ![]() |
