Removing a person from a mortgage?


In Maryland

My sister in law refuses to let my wife take her share of the equity out of their home. She has been unreasonble to say the least, even when we offer to make the differance in the payment of the new mortgage. And on top of this she has been late on the payment 6 times last year. We all live in this house, and we want to move out. But, I feel we should'nt until we resolve this matter. How can we legally remove her unwillingly?

Q: How can we legally remove her unwillingly?

A: Plan A -- Hire a lawyer to file a partition lawsuit. The place will be sold on the courthouse steps and the proceeds (if any) will be split by y'all. You can bid on it at the auction. Set aside $20K and three years for all this to get resolved.

Plan B -- Do some serious negotiating.

both plans are acceptable options.
