renting a house in forclosure


Montana

I am currently waiting for my second refinancing offer, and once i get it signed and back to the mortgage company with the first payment of the new mortgage the forclosure date that is currently set will be lifted. It's a done deal. My question is, can I legally rent my home to someone before all the mortgage paperwork is finalized?

No you cant,will you could but will have to pay back all the money that the renters pay to you.

The previous poster is wrong. The loan has not been foreclosed yet, and right up until the day they foreclose you own the property. If you are sure that it is a done deal you have every right to rent the property.

You are NOT allowed to charge rent AFTER a foreclosure as the property no longer belongs to you.But this has not happened.

Just be sure you will be having the foreclosure canceled or you are just asking for problems.Good luck.

in the state of florida,you cant rent a forclosure property.if you do you will have to pay all rent back.a lawyer told me this.

I believe that applies after the house is foreclosed.Unless Fla. has a specification that makes it different, the house is owned by the property owner up to the day of foreclosure.

Since the owner is renegotiating his loan,and says it is all but done, I believe he is within his rights to own rent the property.
