What is the name of your state? mass.

do deeds and trusts need to be recorded to complete the sales and transfers?

Need more information to offer an opinion. Where in the process are you? Why does this have any bearing on the transaction?

recording questions


mass.

back in Oct. 2005, i deeded my home into a trust with someone else (not a family member) as trustee and beneficiary. i am now trying to sell the house to my father. i did not record the instruments because i didnt have the money to at the time. now the mortgage company is telling me the sale will not be an arms length transaction because i owned the property. but i legally have not owned this property since i signed and had the documents notarized, right?

A: No. Once these instruments are signed, sealed, and delivered, they are effective. Recording puts them on public notice.
