return of property


What is the name of your state? Texas
I paid my arrears mortgage payments ($6130.90) to bring my past due mortgage current on friday 12-01-2006 4 days before auction date. Payment was sent as requested, and where requested by Countrywide.

My home was still auctioned off and sold on tuesday 12-05-2006.
Countrywide was informed the prior friday (12-1-2006) that the funds had been sent USPS overnight and were provided with a tracking number.

Their legal staff assured me that the lawyers handling the foreclosure sale would be informed immediately and the property would be removed from auction sale.

Countrywide received the payment in the form of a Wells Fargo cashiers check on monday 12-4-2006, at 9:36 AM cst and signed for it.

They neglected to notify the Burke attorney firm that good funds had been received... or the law firm chose to proceed with auction on tuesday 12-05-2006 @ 9 AM cst... even knowing the past due payments had been received and theloan was current and paid up through the current month (december).
What are my remedies?

Remember each state has different time frames but there is usually a period of time after such a sell that you have to "redeem" the property.

You need to immediate contact an Atty versed in real estate to explain this process to you and help you resolve this. Time in many areas is of the essence so do it today.

I hope you can save your home but do not sit or you will not!
