| summons incorrect What is the name of your state? Indiana
My home was forclosed and in the summons the bank stated that I had not made a payment since march 13. I have my bank documents that show they pulled 2 payments in march and april. Also the plaintiffs plea to the court were mixed up with someone else so the county and stated persons for judgement were incorrect. The attorney signed that all information was true. If these were not true how could the court find in favor of the plaintiff? I was also assured by the bank that they stopped foreclosure because I sold the house and they signed a short sale document. My HUD 1 form showed I owed 200.00 at closing which was paid. They want the difference of the judgement and the sale. I've learned to get everything in writing now. I would like to appeal the judgement based on false reporting. How do I do this? I don't have the $ for a lawyer. I know it sounds as if I'm trying to shirk my responsibility. But when the foreclosure started I contacted the bank and a real estate agent and listed the house. I had a full offer in 1 week. I kept in contact with the bank throughout the sale. They foreclosed 1 week before the closing. I had no idea they did this until 30 days after closing.
