Title Never Filed - Lien Invalid?


What is the name of your state? Texas

We bought a manufactured home & started out with a construction loan thru their Mortgage Co. We understood that at closing the loan would transfer to another long term mortgage company. Final closing was Jan. 12, 2004. The title company that handled the paperwork contacted us in June, 2005 saying the title to the manufactured home was never filed. They asked us to fill out the paperwork to file it or we would have to cover the costs ourselves. I in turn contacted the retailer, he said they sent the paperwork in so turned him to the lady with the title company for them to talk. The title company contacted me back & said she didn't get any response from the retialer manager (no suprise). My husband & I filled out the form, had it notarized, mailed it back, & confirmed the title company recv'd it. Recently I went to check our current property taxes & found that the homestead exemption is still non-existent (doesn't happen til the title is filed with the state). When I called the title company they referred me to another person, then again another person. I recv'd a cert. letter this week with the same form again requesting us to fill it out. NOTE: The title company brought a retiree out of retirement to fix this, we were informed that our loan was not the only one this happened to. From estimation on our property taxes we have overpaid about $300-$350 a year w/o the exemption. I also just recently found that there is supposed to be a notary present when closing, guess what, no notary, on our copy of the closing paperwork we received there are no notarization stamps, signatures, etc. What recourse would you seek on this matter being that according to your state your home & its installation is non-existent right now?? Also, our loan has transfered to two different mortgage co. whom didn't catch this as well & when I contacted them I was told that their lien was invalid & thats all they said.
