Trouble with my lender


What is the name of your state (only U.S. law)? Florida
I carried an escrow shortage through most of 2008 which increased my mortgage payment. When I paid off the shortage in October 2008, my payment never adjusted back to the original amount. Since November 2008 I have called my lender no less than twice monthly to inquire and they keep telling me that they will do an escrow analysis and readjust the payment. They also have told me to just pay the original amount and the system would fix itself once the analysis was complete.

Well its been 3 months and the system hasn't fixed itself. I am now receiving foreclosure letters and threats of adverse credit report actions etc... because of the way the "system" applied my payments. I continue to call my lender and every representative I talk to can "see" the problem, but the only thing they say they can do is order the escrow analysis- which still has never been done.

If I could I would fire my lender but in light of the current economic situation facing us, I am unable to pursue another loan/refinance.

Totally stressed out and looking for options. Are there any avenues of recourse for me? Thanks What is the name of your state (only U.S. law)? Florida

**A: pay the amount to settle the issue then argue in writing via certified rrr mail.
