Trust+Mortgage=hell


What is the name of your state?minnesota

So, the trustee of our trust (I am a beneficiary) took out a mortgage for 50,000 on the home (which is in trust). thing is, she didnt tell the lender that there was a trust on the property.

now she hasnt paid the main mortgage in 4 months, and says she wont sell the house until we agree to her proposals (which she demands 78,000 from 120,000).

another thing is, she took oiut a line of credit using the equity and hasnt paid that since may of 2004. in this she didnt say the house was in trust either.

my question is this, does her not stating the house is in trust when she received the loan make the loan null and void? I know that she is guilty of fraud.

No, the loan is valid. Contact an attorney ASAP in order to prevent from loing the house.
