Question

Trying to stop Foreclosure?


What is the name of your state (only U.S. law)? Florida

In June I was served with forclosure on my home. I responded with a Motion to Dismiss based on the lender (WaMu) having lost the original note. In September the lender's attorneys filed a motion for Summary Judgement. Until now neither motion has been ruled upon. Since these motions I have been trying to work with WaMu's loss mitigation department to try to save my home. I have offered to begin making partial payments and wish to negotiate a new mortgage. To date they have not responded to any of my correspondence. I have filed copies of this correspondence with the court.

Must the court rule on my motion to dismiss prior to ruling on the motion for summary judgement?

Must I be given notice of a hearing before a Summary Judgement can be made?

Will the court take into account my efforts to try to work with the lender and the lender's completely ignoring these efforts?

Is there something else I can do?
