Unlawful Detainer Action


What is the name of your state? Missouri

K, LSS, on 6-12-07 house was foreclosed and sold to a real estate investment co... they said we could stay for so much per month WHICH I can't pay or I won't have the down payment on the home I am moving into on 9-5-07, in the meantime they have filed this unlawful detainer action suit which has a court date of 7-30-07, I CANNOT afford an attorney as my husband is on disability and we just don't have money laying around, if we did probably wouldn't be typing this thread.

Anyway, what if any are my options in this situation, they are now asking for a ridiculous amount in their judgment and I really don't know what to do next.

Either pay them or move out of their house!

(And just so we understand . . . you stopped making payments on your house, as per the mortgage agreement. The house was foreclosed upon, yet you continued to live there, paying nothing. The new owner wants you to either pay rent or move out, but you want to continue to live there for free until you close on your new house on 9-5-07. Do I have it right? Why do you think you do not have to abide by a legal contract (mortgage) and why do you think you should continue live there for free? Why do you think you should even be entitled to another house? Is the mortgage for this new house also in your name? I wonder if the new mortgage company knows about the foreclosure? If they find out before you close, I bet they change their minds and not give you the mortgage.)

WOW thanks for the insight, couldn't have figured that out on my own.
GUESS I thought this was a legitimate Forum where people at least ATTEMPTED to be helpful, SO SORRY for obviously bothering you.

Just to clarify, no you don't have it right, we were behind due to my husband being on disablility, we at no time STOPPED paying, no i do not want to live there till 9-5-07 free of charge, but also can not pay the RIDICULOUS amount they are asking for. Again WOW!!

Hmmm, they foreclosed upon you while you were making payments? That's a new one. What did the judge say when you showed him proof that you made your payments?

While I understand that your husband is on disability there was no reason on this green earth why a person would continue to pay a mortgage KNOWING that the house was being foreclosed on. You, apparently, weren't in contact with the mortgage company. If they were in agreement with your plans, they wouldn't have foreclosed. Therefore, you should have had at LEAST 6 months of nonpayment. That 6 months of nonpayment could have allowed you to move sooner.

Start packing or you might consider applying for Section 8. This way your LL will not be footing the bill for your free stay at the house. We the tax payers would be.
