I have a 5yr ARM now owned by Chase. (first adjustment in June 2008)
Adjustable rate is 4.5%..Standard adjustable rate note until you get to section 4d "Limits of Interest Rate Changes"
The blanks are filled in to state that "the first change date (June 2008) my rate will not be greater than 4.500% or less than 2.250%. The last sentence states that "My interest rate will never be greater than 4.500%" This is the only document with rate info and the document I signed at closing.
Question: Must Chase honor the terms of the mortgage rate note?, even though it is pretty obvious that someone made an error with the rate info. The original mortgage company never caught the error and neither did Chase when the purchased the mortgage. | |
