what am I entitled to???

What is the name of your state? Pennsylvania

I bought a home almost two years ago with a dude...I moved out three months later. He's been living there, paying the mortgage, etc. We have been waiting to refinance and the time has come. I paid all of the downpayment two years ago, more than half of which I have not seen back. $3000 of what I paid was reimbursment money from a school district I worked for (I paid for grad classes on a credit card)--this money has been sitting and collecting interest for two years.

Basically, we want to refinance. LEGALLY, what am I entitled to? IF the value of the house has risen $25grand, how much of that is legally mine? Besides the money he owes me for the down payment, what else am I entitled to? And, what should I do to ensure I can get this?

first off, are you still on title? Second, does this "dude" hold a contract stating that he'd pay you back for the down payment that you fronted for the home or was it a verbal "buddy thing"?

"Dude" and I do not have a contractual agreement. There is nothing in writing--except both of our names on the deed and the mortgage.
