Whats Going On?


What is the name of your state? OHIO


February my father passed. At this time my mother and sister abandoned me and took off and hasn't spoken with me since. I became the legal administrator in April. I called the mortgage company and faxed over my letter from the judge numerous times. They kept saying they didn't have the letter, which since they wouldn't talk to me, it went into forclosure. Finally, after speaking with their legal counsel, I faxed over my paper and we cleared the deal. I wired the money to set the mortgage straight. They dismissed the forclosure suit against me and the estate. AFTER that was dismissed, they came in and changed all the locks, sealed up my house, and drained the water tank. Now I am back again at the point where they say they dont have my letter and even if I fax it in, it will be 3-5 business days to have them enter it into the computer and then we can set appt to let me in the house. What are my options? I don't think its fair for them to do this, and then make me wait on their time

Did you contact their legal counsel again? Demand a key and funds needed to restore the house. If you have proof you paid and hopefully a letter stating they dismissed the foreclosure, break into your house. If need be, sue them for whatever it takes to restore the house.

I did contact their legal counsel. I never received word back from them. I spoke to the mortgage company today and they said they couldn't do anything atleast until monday and if it wasn't fixed by monday, to call them back. I don't have a letter dismissing the forclosure, but it was communicated to me that it will be dismissed the next day because I paid in full. Who should be held responsible for ordering the illegal break in on my house? The only way I can break in is to actually bust a window since they have bolted and seal all the windows and doors. I tried to kick in the door, but its reinforced.

If you know that you are 100% in the right, hire a locksmith to get into the house for you.

WHO was in title?

Have you or they FILED probate? If so, has a PR been appointed to legally act on behalf of the estate?

Are you an adult or minor?

I am an adult. I filed probate in April. I was appointed administrator of the estate. The mortgage was currently 1 month behind at that point. I contacted Wells Fargo to explain the situation of getting my fathers IRA released so I could pay the mortgage. They couldn't speak with me until I faxed them the letter showing I was administrator. I faxed numerous times throughout April and May. In june, I obtained an attorney for probate and he faxed over my letter of authority to Wells Fargo. At the end of June, Wells Fargo initiated forclosure on my fathers house. My attorney spoke with the legal counsel for Wells Fargo and explained the IRA situation. At that point, we had a date when we would receive it. They scheduled a court date for Aug 16th for the forclosure hearing. If i got the money beforehand, I could pay of the balance and not go through the proceedings. I received the money Aug 7th. Aug 8th, I wired the balance through 5/3 bank per the instructions faxed by the attorney for the mortgage company.
The forclosure was dismissed on Aug 9th. I go pick up the mail at the house at 11am and everything was fine and dandy. I come back at like 8pm and its completely bolted up. I called my attorney the next day. I took pictures of the stickers and he emailed the attorney for Wells Fargo. I suspect since it was friday, nothing immediately got taken care of, but needless to say, I haven't heard anything from my attorney or theirs.
At that point , I decided to call Wells Fargo, where I was once again informed that I am not listed that they have letter of Authority, even though it was faxed multiple times.
After speaking with a supervisor, I was informed that I can fax in the letter of authority and it will take 3-5 business days for that "dept" to note it and then we can set up an appt to have someone come out and let me in the house.
