Question

who is 1st and 2nd?

What is the name of your state? Ohio

I took out a HELOC in 1998, then refinance in 2000. When I refinanced in 2000 they (ameriquest) were suppost to payoff HELOC and close it which was not done. My question is the HELCO the 1st mortage now (since in has the oldest date) or is my primary still the 1st?

**A: it depends upon the exact circumstances. Order a current title report.
