Writ of Possession- PAWhat is the name of your state? PA My boyfriend's 88 year old dad, had his home foreclosed on. A writ of possession was served 11/7, which I believe gives them 20 days to get out. We're are working on it the best we can. 50 years of stuff if you know what I mean. Yikes Anyway, they went to a lawyer again last night, whom said he could help them? I find this so so hard to believe. The lawyer said he could file for bankruptcy and try to sell the house???? $2,500 rip off I believe. 1) How in the world will filing bankruptcy now help? 2) How can they sell a house they no longer own. | Thanks Ron. At least I am not going crazy. I have been researching this whole foreclosure process for them the best I can. I am not 100% sure if they gave this lawyer the money yet, so I am trying to find out if I can get some real advice to stop the waste of money. But do you have any insite as to how bankruptcy at this point (the end, done, foreclosed), would be of any benefit? Thanks |

| It would depend on whether he has other debt and other assets. If the foreclosure left a deficiency, then they might pursue him on that which a bankruptcy might give him relief on. But if he's an living on social security and has no real income or assets, there's nothing really to collect upon. |

| I agree with Ron's advice. Better double check the time before you can be set out after the writ of possession is filed. Here in Ohio it's 3 days (or is it 5? I can never remember.) |

| Linda, It was served on Nov. 7th and as of this afternoon, the good ole sherrif's have not shown up. We just removed two vehicles last night and keep packing and storing. SO SO much emotional fun for everyone. The max. should be 30 days in PA, but we shall see real soon here!!! ![]() |
