What is the name of your state (only U.S. law)? GA, Forsyth Co
I am a HOA Board Member of a newer community. The Board is divided amongst ourselves. I read that our Covenants give the board the ability to levy and collect fines; it says so under a particular article. Other members say no actual $$ amount is listed for covenant violations, so we are not able to assess and collect fines for violations. Several of us also say that our Covenants allow the Architectural Committtee to "promulgate rules." We take that to mean we can set forth rules AND penalties (25$ fine per day per covenant violation) and enforce them. The others say that is not what is stated or implied. Any advice?
