Is there a time period for adverse possession & prescriptive easement to be valid?
We purchased our home February 2002 and our neighbor purchased November 2000. The people we purchased from were absentie from June 2001 and the neighbors house was a rental prior to their purchase. The neighbors told us that they had the right to use our driveway to reach the back of their property. We have recently researched the easement and found that the easement is to our benefit not theirs. So we are planning to end their use of our driveway and preserve the value of our property. However we are concerned that they will claim that they have been using it all along and they have the right to do so. Is there a period of time for this to be a problem for us?
