What is the name of your state? California

We have a now 2 year old situation with a developer next door to us. They encroached onto our property (We had a survey done to verify this), and undercut us causing our driveway to crack. They also illegally removed 150 feet of 15' tall, 4' deep hedges.

We hired an Attorney about 1 year ago and after his trying everything we were finally advised to file a lawsuit (This VERY SMALL developer by the way has had over 30 suits in the past 15 years).

To make this short - its been hell. We finally had to let our Attorney go because he sucked us dry finanacially, and literally not only has nothing gotten btter, he has made things worse for us.

We are now scheduled to go to some sort of pre trial meeting, and cant afford another attorney. So we want to just take our loss and go on with our lives a this point. Is there a way we can dismiss our suit without an Attorney? If so, how?

If the developer did not file counterclaims back against you, then you can simply file a notice of voluntary dismissmal (with or without prejudice) with the clerk of the court. If the developer has counterclaimed, you can still dismiss your claims, but you can't dimiss theirs -- you could consider talking with them about jointly dismissing the case, in which case you could file a joint notice of voluntary dismissal.
